Terms of Service

Last updated: May 2025

1. Acceptance of Terms

By accessing or using any service provided by PearTech ("we", "our", or "the Company"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

PearTech provides AI automation solutions, AI calling agents, lead generation systems, and web development services to businesses. The specific scope, deliverables, and pricing for each engagement are defined in a separate Statement of Work or service agreement signed between PearTech and the client.

3. Client Responsibilities

Clients are responsible for providing accurate information required for service delivery, ensuring that the use of our AI systems complies with applicable local laws and regulations, and obtaining any necessary consents from their end users for automated calling or communication services.

4. Intellectual Property

PearTech retains ownership of all proprietary technology, frameworks, and methodologies used in the delivery of services. Custom deliverables created specifically for a client — including websites, automation workflows, and configured AI agents — are transferred to the client upon full payment, unless otherwise specified in the service agreement.

5. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. PearTech will not disclose client business data, customer information, or operational details to third parties without explicit written consent, except as required by law.

6. Limitation of Liability

PearTech shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability in any matter arising out of these terms shall not exceed the total fees paid by the client in the three months preceding the claim.

7. Termination

Either party may terminate a service agreement with 30 days written notice. PearTech reserves the right to immediately suspend services in cases of non-payment, misuse, or violation of these terms.

8. Governing Law

These terms are governed by the laws of Pakistan. Any disputes shall be resolved through good-faith negotiation; if unresolved, through arbitration in Karachi, Pakistan.

9. Changes to Terms

We may update these Terms of Service periodically. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of material changes by email.
